Terms of Service

1. Introduction
These Terms of Service govern use of the OnlineHelp platform operated by BlueberryS Digital s.r.o. (hereinafter the „operator"). By using the platform you agree to these terms.
2. Definitions
- Platform — the OnlineHelp web and mobile application.
- Expert (provider) — a natural or legal person who offers expert advice, content or subscriptions through the platform.
- Client (customer) — a user who buys services or content from an expert.
- Organization — a business entity that can have associated experts.
- Ticket / Consultation — an individual paid consultation between a client and an expert.
- Content — articles, guides, video or audio materials that experts publish.
- Subscription — a recurring monthly / 6-month / yearly access to an expert's content.
3. Registration and account
To use the platform you need a working email account. Passwords must be at least 8 characters long and not known from prior breaches (we check against Have I Been Pwned). You are responsible for safeguarding your credentials.
An expert account can be closed at any time. After closure your personal data is anonymized, but content, subscriptions and tickets remain accessible to clients who paid for them (legitimate business interest under GDPR Art. 17 (3) (b)).
4. Payments and fees
4.1 Platform commission
The platform charges a commission of 8 % of the gross amount of every expert transaction. The commission is deducted automatically when the payment is processed via Stripe.
4.2 Organizations
If an expert is associated with an organization, a part of the revenue after the platform commission goes to the organization based on the agreed split (default 15 %, configurable in the range 0–80 %). The remainder goes to the expert.
4.3 Stripe Connect
Payments are processed via Stripe Inc. The expert (and the organization, if applicable) must complete Stripe Connect onboarding (KYC) before accepting payments. Stripe charges its own transaction fees per its pricing.
4.4 Refunds
Refunds are handled directly between the expert and the client. The platform may act as a mediator in disputes. In case of a refund, commissions paid to the organization and the platform are also returned.
4.5 Affiliate program
Every user has a unique affiliate link. If someone signs up via your link and starts earning on the platform, you receive 25 % of the 8 % platform commission on their transactions, lifetime. Payouts via Stripe Connect Express (€25 minimum, 30-day hold for refund protection).
4.6 Abuse of the affiliate program
The platform reserves the right to cancel, withhold, or claw back affiliate commissions and/or suspend an account upon detecting abuse, including (but not limited to):
- Self-referral — using your own affiliate code when registering yourself (as expert or client)
- Coordinated mutual referrals between connected persons aimed at circumventing the commission
- Fictitious transactions generating commissions without real economic activity
- Multiple accounts of the same person under different emails for the purpose of self-referral
In case of detected abuse, affected commissions will not be paid out; if already paid out, we reserve the right to offset them against future payments or demand a refund.
5. Usage rules
You undertake that you will:
- not provide false information at registration
- not publish content that infringes copyright, threatens security or public morals
- not use the platform for illegal activity
- not circumvent the payment system (asking clients to pay outside the platform)
- not spam or send unsolicited messages
On violation we may suspend or terminate your account without compensation.
6. Content and intellectual property
Content you publish as an expert remains yours. You grant the platform a non-exclusive license to display and distribute the content to clients within the service. We guarantee clients who have paid for content permanent access (or access for the duration of their subscription).
7. Liability
The platform does not provide expert advice itself — experts are independent service providers. The expert is responsible for the quality, accuracy and relevance of any advice provided.
For medical / legal / financial topics, the platform does not replace professional services by a licensed practitioner with direct oversight. Experts must hold the appropriate qualifications under applicable law and disclose them on their profile.
8. Complaints and dispute resolution
Try to resolve complaints first by communicating with the other party (client / expert). If you can't reach an agreement, contact us at support@blueberrysdigital.com. Consumers may also use online dispute resolution at ec.europa.eu/consumers/odr.
9. Changes to these terms
On any material change we'll notify you by email and in the app at least 14 days before it takes effect. Continued use of the platform after that constitutes acceptance of the new terms. If you don't agree, you can close your account.
10. Final provisions
These terms are governed by the law of the Slovak Republic. If any provision becomes invalid, the remainder remains in force. Disputes are decided by the competent court in the Slovak Republic or via online ODR (for consumers).
